1Eligibility

Use of KlimaNowBox products and services requires that you are legally capable of entering into contracts in Switzerland. Customers must provide truthful information during registration and must be authorized to use payment methods provided. KlimaNowBox reserves the right to refuse service where eligibility or authorization cannot be confirmed.

You must be at least 18 years old to enter into a binding agreement with KlimaNowBox. If you are acquiring products for a household or organization, you represent that you have the authority to act on behalf of that entity.

You agree not to use KlimaNowBox products or services for illegal purposes or in a way that could interfere with other users' access. Any misuse, fraud or activity that risks systems or user safety may result in service suspension.

Products, services and offers described on KlimaNowBox.pro are intended primarily for customers located in Switzerland. Availability and delivery terms for other countries vary and may be subject to additional terms and local regulations.

2Account and registration

Creating an account with KlimaNowBox allows streamlined ordering, device management and access to support resources. You are responsible for maintaining accurate account details and for all actions conducted through your account.

Provide accurate and up-to-date personal and billing information. Incorrect information may delay orders, installations or support services. Notify KlimaNowBox promptly of any changes.

Keep your account credentials secure and do not share passwords. If you suspect unauthorized access, change your password and notify KlimaNowBox immediately. We will take reasonable steps to help secure your account.

Accounts are personal and may not be transferred without prior written consent from KlimaNowBox. Any unauthorized transfer may result in account suspension.

If your account is compromised, contact support immediately. KlimaNowBox will contribute and take appropriate action, including temporary suspension and guidance on restoring secure access.

We may suspend or limit access to accounts that violate these terms, that pose security risks, or where contribute of suspected misconduct is necessary. KlimaNowBox will notify affected users where practicable.

3Services and products

KlimaNowBox provides smart climate devices, software interfaces and optional support services designed to improve everyday comfort with practical control of home temperature and air quality. Product features, performance and compatibility are described on KlimaNowBox.pro and in product documentation. Installation may require a qualified technician for certain devices; recorded setup instructions and professional installation options are available.

We may update product features, software and service offerings. When changes affect access or core functionality, KlimaNowBox will publish notices and provide migration or support options where reasonable.

While we aim for responsive service and product availability, temporary outages or supply limitations can occur. KlimaNowBox will communicate expected delays for orders and service incidents and offer reasonable remedies such as scheduling alternatives or product platform options.

4User obligations and rules

Users agree to act responsibly when using KlimaNowBox services. The following rules help maintain safety, reliability and a positive experience for all customers.

• Use products only as intended and follow installation and safety instructions provided by KlimaNowBox.
• Do not attempt to modify devices or firmware in ways that could compromise function, safety or warranty terms.

• Do not use KlimaNowBox services to transmit unlawful, harmful or abusive content.

• Abide by regional regulations and building codes for device installation and operation.

5User content

Users may provide feedback, reviews, photos or other content related to KlimaNowBox products. Such contributions help improve products and help other customers choose solutions.

By submitting content you represent that you have the necessary rights to grant KlimaNowBox a license to use the content. You remain responsible for the content you provide.

You grant KlimaNowBox a non-exclusive, worldwide, royalty-free license to use, display and distribute user content for marketing, product improvement and support purposes. This license helps us show real customer experiences and to refine product features.

You are responsible for ensuring user content does not infringe third-party rights, contain sensitive personal data, or violate laws. KlimaNowBox may remove content that breaches these terms.

To request removal of user-contributed content, contact us with details and justification. KlimaNowBox will evaluate requests and act in accordance with applicable law and safety considerations.

6Intellectual property

All intellectual property rights in KlimaNowBox branding, product designs, software, documentation and website content are the property of KlimaNowBox or its licensors. Unauthorized copying, redistribution or creation of derivative works is prohibited.

• Do not reproduce KlimaNowBox logos or activity without written permission.
• Do not reverse-engineer, decompile or attempt to extract source code from KlimaNowBox software except where expressly permitted by law.
• Respect third-party intellectual property when using integrations or uploading content to KlimaNowBox services.

7Paid services and subscriptions

Certain KlimaNowBox features, installations and extended warranties are available as paid services. Pricing, scope and terms are provided at the point of purchase and in related service agreements.

Prices are stated in Swiss Francs (CHF) and include applicable VAT where required. Any promotional pricing or discounts are subject to availability and time limits. KlimaNowBox will detail costs, recurring charges and billing cycles prior to purchase.

Payments may be accepted via major credit/debit cards and other methods displayed at checkout. Payment information is processed by secure payment providers; KlimaNowBox does not store full payment card data on its servers.

Subscription services auto-renew unless cancelled prior to the next billing cycle. You may manage or cancel subscriptions through your account settings or by contacting support according to the cancellation terms provided.

Refunds for products and paid services are handled per the refund policy provided at the time of purchase. For physical goods, returns may be accepted within specified periods if items are in resalable condition; delivery costs and restocking fees may apply.

Cancellation of paid services should be submitted through account controls or by contacting support. Certain cancellations may be subject to notice periods or non-refundable fees for services already performed.

Customers are responsible for any taxes, duties or charges imposed by local authorities beyond those included in the purchase price. KlimaNowBox will display applicable VAT or sales taxes during checkout for Swiss orders.

KlimaNowBox may adjust prices for products and services. For active subscriptions, price changes will be communicated in advance with options to accept or cancel before changes take effect.

Failure to pay for ordered products or services may result in cancellation, withholding of deliveries or suspension of service until payment is made. KlimaNowBox may pursue collection in accordance with applicable law.

8Disclaimer

Products and services provided by KlimaNowBox are offered 'as is' to the extent permitted by law. Information on KlimaNowBox.pro and associated documentation is intended to inform purchasing decisions and to describe typical product capabilities. Individual results depend on site conditions and correct installation; KlimaNowBox provides guidance to help achieve expected performance.

9Limitation of liability

To the maximum extent permitted by law, KlimaNowBox's liability for direct damages arising from use of our products or services is limited to the amount paid for the affected product or service during the prior 12 months. KlimaNowBox is not liable for indirect, special or consequential damages, loss of benefit or data arising from use of our products or integrations.

10Third-party services

Our services may integrate or work with third-party applications, platforms and cloud services. KlimaNowBox is not responsible for the availability, performance or privacy practices of third parties. Using integrations may require agreeing to additional third-party terms.

11Termination

Either party may terminate service agreements in accordance with the specific terms of the purchase or subscription. KlimaNowBox may suspend or terminate accounts that violate these terms or for security reasons, with notice where feasible.

Upon termination, access to paid features and account data may be suspended or deleted in line with our data retention policies. You may export personal data prior to termination where provided by available tools.

12Privacy

13Communications

Communications from KlimaNowBox may include service notifications, order updates and marketing messages where permitted. You may opt out of marketing communications while continuing to receive essential service messages.

14Changes to terms

15Governing law

These Terms are governed by the laws of Switzerland. Parties agree that Swiss law will apply to interpretation and enforcement, excluding conflict-of-law rules that would select another jurisdiction.

16Dispute resolution

If a dispute arises, please contact KlimaNowBox to seek an amicable resolution. If unresolved, disputes may be referred to the competent courts in the Canton of Vaud, Switzerland, or resolved through agreed alternative dispute resolution where available.
